Land Use Bylaw Cannabis Amendment 2021

Town of Stony Plain Council will hold a public hearing for the purpose of hearing submissions regarding adoption of a Land Use Bylaw amendment to revise setback requirements for Cannabis Retail Sales uses.

Purpose of Bylaw 2651/LUO/21 Land Use Bylaw Cannabis Amendment 2021

To amend the Land Use Bylaw to update Cannabis Retail Sales use setback requirement regulations.

The Alberta Gaming and Liquor Commission (AGLC) has established that a cannabis retail must have a 100 metre separation distance from a provincial health care facility or school site.

The Town’s current Land Use Bylaw 2642/LUO/21 includes more regulations beyond the 100 m separation distance, as municipalities can choose to include separation distances from other uses as well. The Town’s current separation distances between Cannabis Retail Sales include:

  1. 200 metres from public and private education services (schools) and provincial health care facilities;
  2. 100 metres from public playground structures, including skateboard parks, BMX bike tracks, spray parks and outdoor fitness installations; and
  3. 150 metres from any sites that contain an approved development permit for cannabis retail sales.

Administration is proposing to amend the Land Use Bylaw to reduce the first item to match the provincial standard of 100 metres and remove the second and third items to align the Land Use Bylaw requirements with the provincial regulations.

Public Hearing Procedure

Members of the public wishing to address Council with comments on Bylaw 2651/LUO/21 may provide a written submission or make a verbal presentation during the public hearing.

Written submissions must be mailed or delivered to the Stony Plain Town Office at 4905-51 Avenue, or emailed to and received by 12:00 p.m. on September 20, 2021 to be included in the public hearing agenda.

Members of the public wishing to make a verbal presentation to Council during the hearing are encouraged to register their intent to speak by 4:00 p.m. on September 24, 2021. The registration process may be completed by calling 780-963-8589 or emailing and ensures speakers have the necessary information to participate in the public hearing.

All members of the public providing a written submission or a verbal presentation must include their full name and indicate if their comments(s) are in favour or opposition of the Bylaw, or a general comment.
